From Confusion to Clarity: Making Expert Evidence Work

Expert evidence is near-ubiquitous in commercial disputes, both in courts and in arbitration. Yet frequently frustrations and complaints arise about the process: the evidence is not accessible or user-friendly; rival expert reports talk at cross purposes; joint expert statements achieve no common ground; and decision-makers find the evidence difficult to understand and of limited guidance in making their decisions.
This session will look at the causes for these frustrations, and offer recommendations from the perspectives of counsel, experts and arbitrators on how expert evidence can be better prepared, presented, examined and understood by each of the stakeholders in the dispute process, to allow expert evidence to be used more effectively and efficiently. The panelists will discuss in particular proposals for the content of expert reports, the ways in which that evidence should be presented and cross-examined by counsel, and processes that decision-makers could consider in their cases.
