Legal professional privilege is a fundamental part of English law, which allows parties to maintain confidentiality in their legal communications, allowing them to refuse to produce documents or to answer questions.  This session is aimed at providing practical hints and tips in international commercial litigation.  
 
Our speakers will provide an introduction to the principles of legal professional privilege before exploring some of the particular issues that international disputes lawyers should be aware of, such the current limited definition of a “client” for privilege purposes and how the UK courts will treat legal advice provided by overseas lawyers. The practical application of these principles and potential pitfalls will be illustrated through the speakers’ own experiences in practice and via an interactive case study, which will also allow for a comparison of privilege from other jurisdictions via audience participation.
