The last 12 months have seen further important developments in the UK mass claims landscape, ranging from the first post-trial judgment of opt-out collective proceedings in the Competition Appeal Tribunal in Le Patourel, to setbacks for collective securities claims brought under s.90A FSMA. In this round-table discussion, litigators from Travers Smith and Monckton Chambers reflect on what recent developments are likely to mean for mass claims in the UK going forwards, and will be joined by their European counterparts to discuss how this compares to trends emerging on the Continent. Given the varying degrees of success that mass claims have had across different European jurisdictions, the panellists will consider whether there is likely to be gradual evolution or, conversely, revolution, in their respective jurisdictions in this area in the years ahead.
