This session will feature a lively debate among experts from various jurisdictions, comparing and contrasting their respective creditor protection mechanisms and discussing recent developments. From the perspective of England & Wales, the discussion will delve into two significant rulings: El-Husseiny v Invest Bank PSC (which addresses the scope of Section 423 of the Insolvency Act 1986) and the BHS litigation (which examines the interaction between Sections 212 and 214 of the Insolvency Act 1986)
