Pleading and Proving Fraud in Commercial Litigation

This session will look at how to successfully bring or defend claims in fraud in the English courts. Given that English law does not recognise a single cause of action for ‘fraud’, the session will examine the various causes of action which lie against the perpetrators of fraud, and how those causes of action must be pleaded and then proved at trial (including discussion of recent decisions concerning the burden of proof in fraud claims). Interim remedies (such as freezing orders) and tactical questions will also be discussed.
Ed Starling, head of the Disputes Group at Wedlake Bell, will host a panel of experts including: Karl Anderson and Andrew de Mestre KC (Deputy High Court Judge) from 4 Stone Buildings, Katharine Toney from Kroll and Kate Hart from Quantuma; that will examine:
- The various causes of action which lie against the perpetrators of fraud Pleading and then proving fraud at trial – together with a judicial perspective
- The use of interim remedies and strategic decision making
- Practical steps when considering working with experts such as investigators, forensic IT and forensic accountants
