This high-level, international panel will discuss the realities of what is actually happening on the ground in Investor/State Mediation, based on the personal, practical experiences of the panel.
Using a specific case study and other live examples, we will cover:
• The realities of advising clients to go into IS mediations. What concerns do State clients & commercial clients express, how are they addressed in practice?
• What actually happens in IS mediations? Process, preparation and negotiation. How does it differ from other mediations?
• Practical decision-making challenges for States in IS mediations.
• Coordinating IS mediation with IS arbitration – timing issues.
• The practical challenges for mediators mediating IS disputes.
• ICSID’s institutional insights – What trends is ICSID seeing in mediation? What do the stats say?
There will be time for Q&A and we encourage a lively debate.
