In this practical session, our panel will discuss the unique issues that arise in disputes involving States, whether in international arbitration or domestic litigation. Bringing perspectives of counsel, practitioner, academic and expert, we will examine some of the recent English court and international decisions involving government entities and ask the questions: what can make representing or litigating against a State particularly unique? And are there ways of managing these issues better than we do currently?
