Following the landmark English Court of Appeal ruling in Churchill (November 2023), court-ordered mediation has now entered the English dispute resolution landscape. A potential game-changer, the idea of compulsory mediation is not new - having been tested for example in Italy, North America and New Zealand. This panel brings together leading experts from various jurisdictions to explore what makes compulsory mediation truly effective - and what might turn it into a mere box-ticking exercise. Can mediation retain its power and value in this new procedural role, or will it become just another step in the process? Join us for a lively discussion on what’s needed to ensure this innovation doesn’t miss the mark and for networking drinks after the session.
