Using AI for clients' and counsel's benefit in international disputes: insights from counsel, AI developers and the SCC Arbitration Institute

The rapid pace of technological change, particularly with the growing availability and use of artificial intelligence (AI) tools and services, is increasingly impacting international arbitrations and other international disputes.
Whilst the use of AI in international disputes raises a number of questions — such as whether it can be used fairly and appropriately, how confidentiality can be maintained, how AI might help level the playing field, and how challenges to arbitral awards based on procedural concerns can be avoided or pursued — AI also has the potential to revolutionise how lawyers and clients work.
During this seminar, we will explore the multifaceted opportunities and challenges presented by the use of the AI for international disputes. Our panel of experts will discuss:
• The place of AI and other tools and technologies in international disputes, and how these could facilitate a resolution or disable good arbitral procedure.
• The impact of AI on privacy, fairness and confidentiality, and how disclosure norms may need to change to ensure appropriate standards of transparency and accountability in arbitration.
• The new UNCITRAL Code of Conduct, revised IBA Guidelines on conflicts of interest and related recent case law on arbitrator challenges and challenges to awards based on alleged bias.
• Other important regulatory regimes, including the GDPR and EU AI Act, alongside their effects on the use of AI tech in arbitration and on wider arbitral procedures.
• Institutional approaches towards the use of AI. The SCC Arbitration Institute will provide its take on the use of AI by introducing its non-binding Guide on the use of AI in SCC Arbitrations, nominated for Best Innovation at the GAR Awards 2025.
• How supercharging AI can help law firms work smarter not harder. Aavagard, a dispute resolution firm, and its sister legal technology company, Aavalynx, will detail their innovative mission to change the way that law firms successfully handle large, complex disputes with the help of AI.
• Predictions for the future, grounded in reality to dispel common misconceptions, with pragmatic advice and guidance on the ways the arbitration community can prepare for, respond to and embrace the changes that AI is ushering in.
