This panel will discuss:
a) Developing robust trade secret protection polices particularly with the emergence of Artificial Intelligence. As AI becomes more ubiquitous, even conservative companies are compelled to consider utilizing and developing AI in their day-to-day operations. What risks does that bring and how can businesses best protect their AI-generated content and innovations across multiple jurisdictions, many of which have different rules governing the ownership and protection of such inventions?
b) Collaborating with partners (ensuring that supply chain partners adhere to strict security protocols to prevent leaks and breaches; when entering joint ventures or alliances, clearly defining the handling and protection of trade secrets in the agreement; incorporating geopolitical risk into joint ventures / alliances due diligence)
c) How to strategize trade secrets enforcement, particularly cross-border, including optimizing legal approaches (arbitration vs litigation; injunctive relief and damages; forum selection; etc.)
